Shape, form and color of an article and combinations thereof can be protected as design patents. Image designs (layout, icon, etc.) of IT, various industrial designs, characters and fabric patterns are also subject to design patents.
Consulting
It is possible to consult with us regarding the content of design. Any sample, photo, or modeling image must be provided to us.
Prior design search
Prior to filing a design application, a prior design search is conducted and our review report describing whether your design is eligible for registration is provided.
Agreement for filing
A general power of attorney (separately provided) and etc., are required.
Draft application
A draft application prepared by a patent attorney in charge is provided within a few days after an agreement for filing is signed.
Filing
After filing, our filing report is sent.
Examination
Accelerated examination
If a request for accelerated examination is filed, an examination report would be issued earlier than the normal examination period.
Response to office action
An office action once issued by KIPO in the course of examination must be responded to in due course.
Registration
Where a notice of allowance is issued, the registration fee inclusive of the 1st to 3rd year annuity fee is to be paid. Upon payment, a certificate of design is issued.
After registration
Where a third party uses a registered design without authorization, it is possible to send an unauthorized user a warning letter, charge the user with a crime, or lodge a claim for damages against him/her. iSquare does its utmost to represent any and all legal actions available for protecting the design holder.
